中国生存权意义探讨

2016-08-30 01:05 摘 要 近二十年来中国社会由于从国有制计划经济向现代市场经济制度转型所发生的巨大变化，以及社会分层的明晰化，使得生存权无论在对个体中国人的一般生活和心理影响方面，还是在对社会各阶层的实际影响方面都具有了更重要的和日益迫切突出的意义。当普通民众生存权遭到威胁时，更在反复检验着目前国家宪政的合法性；而当国家的独立和生存成为问题时，人民的生存也难有保障。最终要落脚到中国国家的整体生存权上。当前，宪政理论要适应宪政现实的需要，就迫切需要把生存权问题提到更突出的高度，放在与时代社会相称的位置上予以探究。关键词：生存权 中国 宪政 意义

In the recent two decades, thanks to the great changes from State-Owned Enterprises and planned economy to modern market-oriented economy in China, and the explicitation of the social class, subsistence right(the right to live) has became a more important and urgent need not only to the aspect of common lives and psychological affects of the Chinese individuals ,but also to the practical influence of each social class. Common people's subsistence right being threatened, repeatedly checks the legality of the current constitutionalism in the country;however, when a country's independence and existence are in danger, people's subsistence rights cannot be guaranteed. That is why people's subsistence rights must be based on the subsistence right of the Chinese country. If we want to make the theory of constitutionalism meet the practical needs of constitutionalism at present time ,we'll be urgent for raising up the status of the subsistence right and having researches into it at a proper status fitting the modern society.
Key words: subsistence right, China, constitutionalism, significance.生存权属于宪法所规范的公民权利的一类。自从一九九一年十一月中华人民共和国国务院新闻办公室发布我国第一份人权白皮书《中国的人权状况》并提出“生存权是中国人民长期争取的首要人权”论点以来，生存权在国内的研究已取得了一定的发展，但相比其他公民权利研究和法学学科，生存权的国内研究仍处于新兴发展阶段。处于巨大社会变迁的中国，其生存权研究已赶不上时代需要。关于生存权意义的研究，国内仍为官方学界阐释所主导，围绕生存权本位抑或自由权本位进行探讨争鸣。我国学者一般对生存权的认识主要表现在概念和中国的现实需要上，对生存权在中国的意义则少有专门论述。在国外，生存权研究亦属于一门新兴的宪政学科。在向来以自由权（政治权）和财产权为关注重点的欧美发达国家，生存权研究几乎属于边缘学科。目前国际上生存权研究走得较前的是日本。
