论行政诉讼的和解

摘  　要

行政诉讼和解是原被告在人民法院主持下在庭审阶段就诉讼标的互谅互让达成合意以解决纠纷的诉讼制度。行政权在特定情形下的可处分性、解决纠纷的诉讼目的及现实中的需要等为行政诉讼和解提供了理论与现实依据。在构建我国行政诉讼和解制度的同时应进行必要的限制。

Abstract

Compromise in administrative litigation is a litigation system in which the parties compromise in the course of court trial under the charge of the court. The theoretical and reality basis of compromise in administrative litigation include: The executive power under the specific situation may the punishment, the goal of litigation, in reality need etc. While constructs our country administrative proceedings reconciliation system to be supposed to carry on the essential limit.
