【标题】On Perfection of Constitutional SupervisionSystem in ChinaGAO Lin【提要】我国现行宪法监视制度存在明显的缺陷，尤其是没有专门的宪法监视机构，违宪审查较为薄弱。当今世界有议会或权力机关监视、普通法院监视和专门机构监视三种宪法监视模式。应立足国情，和鉴戒外国先进的立法模式和经验，设立专门的宪法监视机构，即独立的宪法专门委员会，有效地审查和纠正违宪行为，以完善我国的宪法运行机制，充分发挥作为根本法的宪法的作用。【英文摘要】re are obvious defects in the existing constitutionalsupervision system.The lack of a special agency forconstitutional supervision and weak unconstitutionalityreview present serious problems.At present,there are threekinds of constitutional supervision models in the world,namely,supervision from parliament or from power organ,supervision from common court and supervision from a specialagency.Based on Chinas current situations,we shouldsummarize and borrow the advanced legislation model andexperience from abroad and establish the specialconstitutional supervision organ--the independentconstitutional committee.In this way can we examine andrectify unconstitutional action effectively,make theconstitutional operating system more perfect,and thus fulfilthe role of constitution as the basic law of China.【关 键 词】宪法监视/监视模式/监视机构/违宪审查/宪法法院constitutional supervision/supervision model/supervisionorgan/unconstitutionality review/constitutional court【 正 文 】
