论刑事审判监督程序律毕业论文

摘   要
   刑事审判监督程序虽然不是刑事审判的必经程序，但从整个刑事诉讼程序来看，它的运行关系到人民法院生效判决的稳定性，也关系到国家刑罚权实施的公正性以及诉讼当事人的权利保护。因此，针对当今中国刑事审判监督程序存在的主要问题，进行深入的探讨，提出完善刑事审判监督程序的对策和建议是很有必要的。

ABSTRACT
Criminal retrial proceeding is not essential to criminal judgment, however, from the point of view of the whole criminal proceeding, how it runs will relate to the stability of sentence in operation produced by demotic court, it will also affect the fair of national penalty right and the right protection of litigant. Therefore, home discuss the main problems exist in Chinese criminal retrial proceeding, bring forward some countermeasures and suggestions to perfect the criminal retrial proceeding are very necessary.
