【内容提要】是否在WTO内谈判制定新的综合性的投资规则，争议颇多。主要争议在于分析欧盟、非政府组织和发展中国家的立场，依据若干客观标准总结在WTO体系内进行多边投资规则谈判的利与弊，其有利之处在于广泛的国际社会参与、弥补现行双边投资条约的不足、保持相互依存关系的平衡等，其弊端在于WTO的投资规则难于与现行区域投资协定保持一致，发展中国家政府能力较弱等。但总的说来利大于弊。 【摘 要 题】WTO法制专栏 【英文摘要】Whether to draft new investment regulations through negotiations in the WTO remains a bone of contention. The paper examines the respective positions of the European Union, NGOs and the developing countries. Then it discusses the advantages and disadvantages in WTO' s multi-party negotiations on investment regulations. Broader international participation, improvement of the current bi-party investment agreements and balance of interdependence are believed to be the advantages while the unconformity of WTO' s investment regulations with the current regional investment accords is a disadvantage.
