法律英语的文体特征及其翻译策略

On the Stylistic Features and Translation Strategies of Law English

Abstract

Law is the rules and principles for human behavior, his rights and duties and the conduct of government in an organized community, state, or nation, created or recognized by customs or by government institutions and implemented or enforced by the government. Law English is one of law language, which belongs to the scope of applied linguistics. Language is the medium of communication, and of course laws are expressed by language. English is widely used in the world today. So law English is playing an important role in the world. In order to learn law English well, it is necessary to study its stylistic features and translation strategies. In this thesis, three points are mainly talked about. The first point is the concept of law English, and the second one is to analyze stylistic features of law English. In the aspect of lexical features, they refer to formal words, archaic words and phrases, words of foreign origin, special use of common words and use of professional terms and argot. Grammatical features include long sentence, complex post modification and simpler verbal groups. Semantic features list lexical repetition, conjunctional phrases and parallel structure and meticulous way of expression. The last point is to discuss translation strategies of law English—accuracy and precision, consistency and identity and professionalism.

摘 要

法律是1种规范，是由政府或其他权力机构制定或认可的准则、规定或规则。是规定人们权利和义务的规范，是有国家强制力作保障的规范。法律英语是法律语言的1种，它属于应用语言学的范畴。语言是交际的桥梁。法律是通过语言来表达的。如今英语在全世界被广泛的应用，法律英语也正发挥着重要的作用。研究法律英语的文体特征和翻译策略对学好法律英语是10分必要的。在该中，我们主要讨论了3个问题。第1点是法律英语的概念。第2点是分析法律英语的文体特征。在词汇特征中，主要涉及了正式用语、古老词语和外来词语的用法，还有普通词的特殊用法以及专业术语。语法特征主要包括句子冗长、后置定语复杂和动词词组简单。语义特征则包括了词汇重复、短语连接和结构并列以及表达谨慎。第3点讨论法律英语的翻译策略——准确性和精确性、1致性和同1性以及专业性。我们以上分析的这些对我们掌握法律英语是10分有帮助的。
