论刑事侦查的羁押期限律毕业论文

摘       要

我国刑事侦查羁押现状的突出特点就是超期羁押现象严重。羁押成为了常态，羁押期限制度存在不确定性，羁押期限的适用不符合比例原则，有关羁押期限的司法救济功能缺失。解决超期羁押问题，应法定羁押条件、羁押期限及适用，完善羁押期限制度保障，构建预防和纠正超期羁押的长效机制。
