死刑复核程序的现状与改革律毕业论文

摘   要

死刑复核程序是死刑案件的必经程序，是防止错杀误杀的最后1道防线。随着死刑复核权重新收归最高人民法院统1行使，又掀起了学术界、实务界对死刑复核程序如何完善的激烈探讨。现行死刑复核程序，无论是在立法还是在司法中都存在1些不容忽视的问题，导致其设立初衷难以实现，有必要对死刑复核程序进行改革和完善。

ABSTRACT

The procedure of checking death penalty is an indispensable procedure，the last line to avoid undeserved death manslaughter. Because the death penalty checking right re- accept to the Supreme Peoples Court to exercise，and then brought about again the academic and practical sides of death penalty checking procedures perfect intense study. Current death penalty proceedings whether in the legislature or in the administration of justice are some problems that should not be overlooked. Causing it establish the original intention hard realization. It is necessary to review procedures for the death penalty for reform and improvement.
