论土地征收程序的完善与土地承包经营权的保护

摘  要：农村土地承包经营制赋予农民的土地承包经营权是农民的1项重要私权。土地征收是政府行使的1项公权。由于公权的过于强大，土地征收对土地承包经营权带来侵害。如何完善土地征收制度成为保护土地承包经营权的关键。

Abstract: It is an important private right of peasants that the rural land is contracted to run and made to peasants land contractual management right. It is a common right that a government exercises that the land is collected . Because common right too strong, land is it bring and encroach on to land contractual management right to collect. How to improve the land to collect the system and become the key which protects land contractual management right.
