论扶养义务——离婚后扶养义务制度初探律毕

摘  要

离婚扶养制度是1项民事法律制度，即规定无过错方在离婚后不能满足其基本生活需要，有权利向另1方提出扶养的要求，另1方也有义务对其作出扶养的权利义务关系的民事法律制度。建立离婚扶养制度的根本原则是离婚自由以及离婚自由中的利益衡平理论，权利义务关系是其理论依据，实现男女平等和保护妇女的合法权益是其现实依据。建立离婚扶养制度主要是从离婚扶养的适用条件、适用方式、举证责任方面提出构想。

Abstract

The divorce nurture system is a civil legal regime, namely stipulated the non-mistake side cannot meet its basic life needs after the divorce.Has the right to another side to propose the nurture request, another side also has the duty to make the nurture to it the rights and obligations relations civil legal regime.The establishment divorce nurture system basic principle is divorces in the freedom as well as the divorce freedom benefit even theory, the rights and obligations relations is its theory basis, realizes the equality of the sexes and protects womans legitimate rights and interests is its reality basis.The establishment divorce nurture system mainly is from the divorce nurture suitable condition, the suitable way, presents evidence the responsibility aspect to propose the conception.
