论犯罪态度在量刑情节中的定位律毕业论文

摘   要

传统理论往往将认罪态度作为量刑情节中1个很重要的因素来考虑。司法实践中认罪态度好，往往成为减轻刑罚，降低刑罚等级的重要依据，这违背了罪责刑相适应原则，给社会带来很大的困扰。因此，针对传统理论的不足，对认罪态度与量刑情节作出深入探讨，给认罪态度在量刑情节中作出1个新的定位是必要的。

ABSTRACT

The traditional theory often considers the attitude of confession as a very important factor in Circumstances of Sentencing. In the judicial practice, a good attitude of confession always contributes to reducing a  penalty or lowering a penalty rank, which violates the Principle of Matching Punishment with Crime and Responsibility and brings great trouble to our society. Therefore, it is necessary , by targeting the insufficiency of the traditional theory and making thorough discussions about the attitude of confession and circumstances of sentencing,,to reposition the attitude of confession in Circumstances of Sentencing.
