结果加重犯的内在关系及法定刑配置之思考律

摘 要

我国刑法学界对结果加重犯这种犯罪形态的研究尚存在着认识上的分歧，尤其是对结果加重犯的组成结构存在许多不同的见解。集中了学界中的几种主要的学说，运用辩证唯物的方法对现今争议较大“因交通肇事逃逸致人死亡”的案例加以分析，得出结果加重犯实际应存在3种结构形式。依此对结果加重犯的法定刑进行合理的配置。研究结果加重犯的内在关系及其法定刑配置问题有助于统1结果加重犯的概念，同时也有利于确定行为人的行为性质。

Abstract

There are many points of The aggregated consequential offences in our country criminal law academic circles , especially about the constitution of aggregated consequential offences. Author find the real constitution of aggregated consequential offences by analyze a precedent which named “ death in the traffic accident cause by the troublemaker run away ” and then make the Legal punishment equitable on the basis of the real constitution . Study the intrinsic relationship of the aggravation offenders and the reasonable configuration for the offenders is helpful to unity the concept of the aggravation offenders. at the same time it is helpful to indentify the assence of the prepetrator.
