论清朝的典权制度律毕业论文

摘  要

典权制度是我国特有的1项古老制度，以其特有的便民功能存植于中国千百年。前些年法学界对典权的性质，价值，存废等诸多问题存在争议。本文对典权制度的历史沿革，典权的性质等，特别是在清朝的发展作了系统的分析和挖掘，从纵向上和横向上更清晰、直观的看到清朝典权制度的发展和特点，并从中得到1些启示。

Abstract

Pawning right is the unique and age-old system in China, and it has taken root in China for centuries because of its special convenience. In the past few years, there have been a lot of controversies about the problems such as pawning rights character, value, preservation abolition and so on in the jurisprudential circle. This article has made a systematic study and analysis about the history of the pawning system and the character of the pawning right, particularly its development in Qing Dynasty, from this article, we can know the development and features of the pawning system in Qing Dynasty more clearly and directly in vertical and lateral, and obtain some enlightenment.
