法人犯罪刑罚的困惑与出路律毕业论文

摘     要

改革开放以来，随着商品经济的发展，法人增多，但由于法律制度的不完善也导致了法人犯罪日益严重。同时，由于法学理论界对法人犯罪的研究起步较晚，立法时对法人犯罪的刑罚问题存在不少缺陷。本文从法人犯罪的概念入手，阐述了我国法人犯罪刑罚体系的立法缺陷及其原因，并就如何完善我国犯罪刑罚体系问题提出了1些粗浅的看法。

Abstract

  Since the reform and opening, along with the commodity economy development , legal persons increasing. But because the legal system is imperfect , the corporate crime has been serious day by day. At the same time,because the legal science theory is later to the criminal crime research start, when legislation has many flaws to the corporate crime penalty question . Obtaining from the concept of corporate crime, the article elaborated our country corporate crime penalty system legislation flaw and its reason, and then propose some shallow views on how consummate our country crime penalty system question.
