从《缺陷汽车产品召回管理规定》看中国产品召

摘  要

产品召回是消费者权益保护的1项重要制度，自上世纪610年代在美国确立以来，也因其注重对消费者权益的保护而在世界范围内得到广泛推广。《缺陷汽车产品召回管理规定》的颁布实施，为我国产品召回法律制度的建立开启了1个良好的开端。但它只是整个产品召回制度中的1小部分，我国的产品召回法律制度还需要进1步完善，以适应保护消费者权益的根本需求。本文主要从引入国外产品召回制度中的惩罚性赔偿制度加强威慑机制，完善产品召回法律方面，以及适用产品召回保险降低召回风险方面提出了1些建议。

ABSTRACT

The product recall is an important system on the consumers’ rights and interests protection. Since the last century 60s, it has been established in America, because of its attention to consumers’ rights and interests protection , it has spreaded widely in the scope of the world. “Management Stipulation On Flaw Automobile Product Recall ”promulgated and put into effect , open a good beginning for our country to establish the product recall legal system. But it is only a small part of the whole product recall system .The product recall legal system in our country needs further consummate to adapt the essential demand for the consumers’ rights and interests protection. This thesis will be mainly from quoting overseas product recall system about punitive compensation system to strengthen the deterrent mechanism, consummating the product recall system and suitting product  recall insurance to reduce  recall risks, to put forward some proposals.
