论我国执行救济制度的完善律毕业论文

摘 要

执行瑕疵导致执行过程中出现执行难、执行乱的现象，也正是这么1些痼疾的存在，使得当事人或第3人需要寻求1种足以保护其受损权利的机制，“没有救济就没有权利”。因此，执行救济应运而生。本文指出我国现行法中规定执行救济制度存在的严重缺陷，明确公正与效率、分权与制衡是确立我国执行救济制度的基本原则，并在此基础上，从程序和实体两方面对我国的执行执行救济制度进行完善。

Abstract

The defects of execution cause the phenomenon that the executions are hard to carry out, and the parties or the third party’s right a lot of harm. “No succor, no right .” So, the system of the succor execution occurs. The thesis points out serious defects in the provisions of system of succor execution in current law and makes it clear that the basic principles to the establishment of the system is clean-cut justice and effectiveness as well as decentralization and check and balance. On this foundation, the thesis
designs a system of succor execution on both procedure and entity in China.
