司法违宪审查的正当性争议律毕业论文

摘   要

司法违宪审查是美国宪政体制中相当重要的1环，其在美国产生的两百多年来，其正当性1直备受美国政界和学界的争议。法官的何以有权撤消审查违宪的法律,法院何以能够对抗民意都是司法违宪审查正当性研究的重要问题。本文中将这两点做简单的介绍，并就这1问题阐述观点，以期为中国的违宪审查制度建立提出1些意见。

Abstract

The judicial review of the constitution plays an important role in the constitutional government system of the U.S.A, but its legality has been disputed by the politics and academic of American since it was product. Why the judges have power to abolish the law about the judicial review and how the courts resist the will of people are both important subjects of studying the justice the judicial review of constitution.
