论刑罚的犯罪预防价值律毕业论文

摘 要

犯罪预防是1项宏大的社会工程，刑罚预防是犯罪预防体系中的最后1道防线，是犯罪预防体系中的很重要的1个环节，“因为有了犯罪并为了没有犯罪而科处刑罚”，刑罚预防犯罪的价值不可忽视。但刑罚预防在取得积极效果的同时也必然会给犯罪预防带来1系列的消极影响，也有局限性。为了最大限度地发挥刑罚的犯罪预防价值，1方面必须把刑罚预防与1些犯罪预防措施结合起来，另1方面不要轻易动用刑罚，合理地组织对犯罪的反应，同时有必要对刑罚执行的方法进行改进。从而，有利于整个社会治安的稳定以及全面建设小康社会。

Abstract

The crime prevention is a great social engineering. The penalty prevention is the last defense line in the crime prevention system, and also is the very important link in the crime prevention system. “Passing a sentence because the crime which has happened, and in order to cure the crime at the same time”, the value of the penalty prevents crime should to be noticeable. But the penalty prevention also bring a series of negative effects inevitably to the crime prevention, and also has the limitation while obtains the positive effect. In order to display the maximum value of penalty prevention, in one hand, it must combine the penalty prevention with some crime preventive measures unify, on the other hand, it should not use the penalty easily, but it should organize the crime response reasonably. Simultaneously, it is necessary to improve the method which carries out to the penalty. Thus, it is advantageous to the entire social order stability as well as the well-off society comprehensive construction.
