论危险犯的犯罪中止律毕业论文

摘 要

危险犯是以行为人实施的危害行为造成的危险结果作为犯罪构成必要条件的犯罪。其最主要特征有两点：1是危险犯有独立的既遂状态（完成形态）；2是构成这1既遂的标志是法定的危险状态的出现。这1点在我国刑法界已有许多研究。与此相比，对于危险犯的未完成形态，特别是危险犯的中止犯却很少研究，本文主要是对危险犯犯罪中止状态进行研究。

Abstract

The dangerous criminal is a crime which it as essential condition that the dangerous result which is caused by the behavior person who implements the harm behavior. Its main two characteristics are as follows: firstly, dangerous person has the condition of completing offence independently (complete condition); secondly, the symbol of constituting this completion is the appearance of danger that is indicated by the law Article. This point had been explored by lots of researchers in the judicature field in our country.  On the contrary, there are a few studies on the condition of incompletion, specially the stop of committing crime. This thesis mainly conducts a research on the condition of stopping crime of dangerous criminal.
