刑事附带民事诉讼若干问题研究律毕业论文

摘 要

刑事附带民事诉讼是我国诉讼立法的1项重要制度。随着市场经济体制的完善和发展，针对我国目前立法和审判中遇到的问题，有必要从刑事附带民事诉讼的法律性质、附带民事诉讼当事人的确定、附带民事诉讼的赔偿范围、附带民事诉讼的价值取向等方面进行研究探讨，以便进1步完善我国刑事附带民事诉讼法律制度。

ABSTRACT

 Civil claim annexed to a criminal case is an important system of litigation legislation of our country. With the perfection and development of market economy system,legislation and trial of our country have some questions. so, in order to solve these questions, we must analyse and reasearch the nature of law, the determination of litigant, the scope of compensation and value orientation of civil claim annexed to a criminal case and so on which could further perfect the law system of civil claim annexed to a criminal case in our country.
