清末移植西方法律失败的原因探讨律毕业论文

摘  要

清末法律移植是指本世纪初清朝政府在各种压力下被迫推行的1次自上而下的重大法律变革。其目的是为了缓和人民群众的反抗，挽救濒临崩溃的清朝统治，它虽然使中国法律具有了近代化的外壳，却因在移植外国法律的过程中缺乏足够的经济基础，且忽视了中国法律的传统性以及传统文化的影响，无法深入到现实社会生活中去。在强大的封建体制和保守的文化传统的阻碍下，只得以失败告终。

In the formidable feudal system and under the conservative cultural tradition hindrance, have to is defeated comes to an end.
