土地承包经营权流转纠纷解决的法律思考律毕

摘  要

土地承包经营权流转纠纷类型多样，流转纠纷数量大、隐患大、调处难度大，流转纠纷的形成既有政策和立法的原因，也有司法、行政管理及流转行为自身欠缺等方面的原因。现行解决土地承包经营权流转纠纷的诉讼救济方式和非诉讼救济方式均存在诸多问题。为预防和处理农村土地承包经营权流转纠纷，有必要从立法、行政、村民自治以及司法各个层面思考应对策略。

Abstract

Land contracted management rights transfering are various types of disputes, and transfering disputes have large quantities, hidden dangers, and handling difficulty ect .characters. Circulation disputes both the formation of policy and legislative factors, but also justice, administration and their own lack of transfering and other reasons. Solve the existing land contract management rights transfering disputes and litigation relief means non-litigation relief means there are many problems. For preventing and dealing the rural land contracting and management rights transfering disputes, it is should to from legislative, administrative, villager autonomy and justice at all levels of thinking strategies.
