论宪法的司法适用性

摘 要

宪法作为国家的根本大法，是“公民权利的保障书”，具有其它法律不可比拟的政治性，但宪法也是“法”，除了政治性的1面以外，更有其法律性的1面，不从法律程序角度具体实施宪法，就无法从根本上保证宪法原则得以贯彻实施，无法真正发挥宪法对公民权利的保护作用。因此，我们应该加强宪法的司法适用，这不仅是完善宪法监督，落实宪法实施的需要，也是树立宪法权威，完善社会主义法治应有的题中之义。

Abstract

As the country’s fundamental law, “the constitution is the guarantee of civil rights.” Not only has it the attribute of politics, but also it has the attribute of law. If the constitution not applied in courts, we won’t assure that the constitution’ principles are put into practice, and we won’t assure that the constitution can guard civil rights. So we should strengthen the applying of constitution. It not only the requirement of perfecting the constitution’s supervisory, but also benefit for perfecting socialism’s law system.
