论经济权利的宪法保护

摘  要

经济权利是由于社会的发展，公民对其独立经济地位的主张，而由传统经济自由发展而来的新型复合权利。较之以往的经济自由它还具有公民要求国家积极作为的社会权利性质。在现代宪法和宪政思潮影响下，经济权利已经开始为各国所重视，但是相对于传统的公民权利和政治权利而言，宪法学界对其有关的理论研究还很欠缺，对经济权利的内涵、性质等仍存在争议。就我国宪法来看，对公民经济权利保障还不完善。

Abstract

 With the development of society and the advocation of citizens independent economic status, traditional economic freedom became a new compound right—economic right. Comparing with economic freedom in the past, it has the characteristic of social right. Under the influence of modern constitution and constitutionalism trend, lots of countries have valued economic right highly. But the relative research of economic right less than traditional civil right and political right, and in constitutional school the connotation and the character of economic right still in dispute . To take account of Chinese Constition, the guarantee of private property is not perfect.
